Terms and Conditions
1. Introduction
Welcome to KodiGari.com (“KodiGari”, “we”, “our”, or “us”).
KodiGari is an online vehicle rental marketplace operating in Tanzania. The platform is designed to connect vehicle owners, rental companies, and individuals or businesses looking to rent vehicles.
These Terms and Conditions govern your access to and use of KodiGari.com, including account registration, vehicle listings, searches, communications, subscriptions, and any other services made available through the website.
By accessing, registering for, or using KodiGari, you agree to these Terms and Conditions and our Privacy Policy.
If you do not agree with these Terms and Conditions, you should discontinue using the website.
2. Definitions
For the purposes of these Terms and Conditions:

Listing: An advertisement or description of a vehicle or vehicle rental service published on KodiGari.

3. Role of KodiGari
KodiGari provides an online platform through which vendors can advertise vehicles and customers can discover and contact vendors.
Unless expressly stated otherwise for a specific service or transaction:
KodiGari acts as a marketplace facilitating connections between vendors and customers.
Vendors are responsible for the vehicles they advertise and the rental services they offer.
Customers are responsible for evaluating listings, confirming rental terms, and deciding whether to rent a vehicle.
Rental agreements are entered into between the relevant vendor and customer.
KodiGari is not automatically a party to a rental agreement merely because a listing appears on the website or the parties communicate through the platform.
KodiGari does not guarantee that every listing is accurate, that every vendor is trustworthy, or that every advertised vehicle is available.
Nothing in these Terms excludes responsibilities or liabilities that applicable law places on KodiGari.
4. Eligibility and Account Registration
To use features requiring an account, you must provide accurate and complete information during registration.
You agree to:
Provide truthful registration and contact information.
Keep your account information up to date.
Maintain the confidentiality of your login credentials.
Use your account only for lawful purposes.
Notify KodiGari if you suspect unauthorized access to your account.
Avoid creating accounts using another person’s identity without authorization.
You must be legally eligible to use the relevant services and enter into any applicable rental agreement.
If you are registering on behalf of a company or business, you confirm that you have the authority to represent that entity.
KodiGari may request additional information when reasonably necessary to verify an account, investigate suspected fraud, or meet applicable legal requirements.
5. Vendor Terms and Responsibilities
Vendors using KodiGari agree to the following requirements.
5.1 Accurate Vehicle Listings
Vendors must ensure that their listings are truthful, accurate, current, and not misleading.
Listings should provide relevant information, including where applicable:
Vehicle make, model, and year.
Vehicle category and features.
Vehicle condition.
Rental price and pricing unit.
Availability and rental duration.
Vehicle pickup location or service area.
Relevant rental requirements and restrictions.
Clear and accurate vehicle photographs.
Vendors must promptly update or remove listings that are no longer available or accurate.
5.2 Ownership and Authorization
Vendors must own the advertised vehicle or have the legal authority and necessary permissions to offer it for rent.
Vendors must not advertise stolen vehicles, vehicles they are not authorized to rent, or vehicles whose use or rental would violate applicable law.
5.3 Vehicle Safety and Legal Compliance
Vendors are responsible for ensuring that their vehicles meet applicable legal and safety requirements.
Where required, vehicles must have valid registration, roadworthiness documentation, insurance, permits, and other legally required documents.
Vendors must disclose material limitations affecting the safe or lawful use of a vehicle.
5.4 Pricing and Availability
Vendors must clearly communicate rental prices and applicable charges before a customer commits to a rental.
Any deposit, delivery charge, mileage restriction, driver fee, fuel condition, overtime charge, or other material rental condition should be disclosed in advance.
Vendors must not advertise misleading prices or claim that a vehicle is available when they know it is not.
5.5 Customer Treatment
Vendors must communicate professionally and treat customers fairly.
Vendors must not engage in fraud, discriminatory conduct prohibited by law, harassment, intimidation, or misleading business practices.
5.6 Vendor Transactions
Unless KodiGari expressly provides a different arrangement for a specific service, vendors are responsible for confirming rental arrangements with customers, including vehicle availability, collection and return arrangements, deposits, payment terms, and applicable rental conditions.
Vendors must comply with all laws applicable to their rental business.
6. Customer Terms and Responsibilities
Customers using KodiGari agree to:
Provide accurate contact information when required.
Review vehicle descriptions, prices, and rental conditions carefully.
Verify material information with the vendor before making a payment or travelling to collect a vehicle.
Ensure that they meet the applicable legal and contractual requirements for renting and using the vehicle.
Provide valid driving credentials where required.
Use rented vehicles only for lawful purposes and in accordance with the rental agreement.
Return rented vehicles as agreed.
Respect the vendor’s property and report any damage, accident, or mechanical problem promptly.
Avoid fraudulent inquiries, false identities, abusive messages, and other misuse of the platform.
Customers should confirm whether a rental includes a driver, fuel, insurance, mileage allowances, or other services rather than assuming these are included in the advertised price.
7. Vehicle Listings and Marketplace Content
Vendors retain responsibility for the content they submit to KodiGari, including vehicle descriptions, photographs, prices, and contact details.
By submitting a listing, you confirm that:
You have the necessary rights and authorization to publish the content.
The content does not unlawfully infringe another person’s intellectual property or privacy rights.
The content is not fraudulent, defamatory, deceptive, or unlawful.
The listing complies with these Terms and applicable law.
By uploading content, you grant KodiGari a non-exclusive, royalty-free permission to host, display, reproduce, and format that content as reasonably necessary to operate, promote, and improve the marketplace.
This permission continues only for as long as reasonably necessary for those purposes, subject to applicable law and legitimate retention requirements.
You remain responsible for your content and may request the removal of your listing, subject to any applicable contractual or legal obligations.
KodiGari may review, restrict, refuse, or remove listings that violate these Terms, applicable law, or legitimate platform safety requirements.
8. Rental Agreements Between Vendors and Customers
A rental agreement may be formed directly between a vendor and a customer when they agree to the relevant terms.
Before completing a rental arrangement, the parties should confirm in writing, where practical:
Vehicle identification and condition.
Rental start and end dates.
Total rental price and any additional charges.
Deposit and refund conditions.
Payment method and payment deadlines.
Vehicle collection and return arrangements.
Driver eligibility and authorized use.
Fuel, mileage, insurance, and damage responsibilities.
Cancellation, late return, and dispute procedures.
Vendors and customers are responsible for ensuring that their agreement complies with applicable law.
KodiGari does not guarantee the performance of a rental agreement between users and is not responsible for obligations that belong to the vendor or customer, except where responsibility arises under applicable law or an expressly agreed KodiGari service.
9. Payments, Deposits, and Fees
Vehicle rental prices are generally determined by vendors unless a specific pricing arrangement states otherwise.
KodiGari may introduce or provide listing fees, subscription packages, promotional services, transaction fees, or other paid features.
Where a fee applies, its amount and relevant terms should be disclosed before the user commits to the purchase or subscription.
9.1 Vendor and Customer Payments
Unless an approved payment feature expressly provides otherwise, customers and vendors are responsible for agreeing on payment arrangements and using lawful payment methods.
Users should verify the recipient and transaction details before sending money.
9.2 KodiGari Payment Services
If KodiGari provides an integrated payment service, the applicable payment instructions, transaction terms, fees, and refund procedures will apply to that service.
Users must not share their mobile money PIN, bank password, or other confidential authentication credentials with another user or through ordinary platform messages.
9.3 Refunds
Refund eligibility depends on the nature of the payment, the applicable terms, the reason for the request, and applicable law.
A vendor’s rental deposit or rental payment is not automatically refundable in every circumstance. The vendor and customer should agree on lawful deposit and cancellation conditions before confirming a rental.
Fees paid directly to KodiGari for subscriptions or other services are subject to the terms disclosed for those services and any mandatory refund rights under applicable law.
Nothing in this section removes a refund or cancellation right that a customer has under applicable law.
10. Pricing Packages and Subscriptions
KodiGari may offer different pricing packages or subscription plans for vendors.
The available plans may differ in price, listing limits, duration, visibility, promotional features, or other benefits.
Before purchasing a plan, users should review its description, price, validity period, renewal conditions, and applicable limitations.
Unless expressly stated otherwise:
A paid plan does not guarantee that a vendor will receive inquiries, bookings, or rental income.
Vendors remain responsible for the accuracy and legality of their listings.
Package benefits are limited to those described when the plan is purchased.
Any renewal, cancellation, or refund conditions must be disclosed in accordance with applicable law.
KodiGari may change future package offerings or prices. Changes to an existing paid plan will be handled according to its applicable terms and legal requirements.
11. Cancellations, Disputes, and Complaints
Vendors and customers should communicate promptly if a booking or rental arrangement needs to be changed or cancelled.
The parties should follow the cancellation terms agreed for their rental, subject to applicable law.
If a dispute arises, users are encouraged to:
Contact the other party and attempt to resolve the issue.
Keep relevant messages, receipts, payment references, photographs, and rental documents.
Contact KodiGari if the matter involves a listing, account, suspected fraud, platform service, or alleged violation of these Terms.
KodiGari may assist with communication, review relevant platform information, restrict suspicious accounts, or take other reasonable measures within its control.
Unless expressly agreed otherwise, KodiGari is not an automatic arbitrator or guarantor of private rental transactions and cannot guarantee recovery of money paid directly to another user.
Users retain any rights to pursue remedies through competent authorities, courts, or other lawful dispute-resolution mechanisms.
12. Prohibited Activities
Users must not use KodiGari to:
Publish fraudulent, false, or misleading listings.
Advertise stolen vehicles or vehicles they are not authorized to rent.
Commit fraud, theft, impersonation, or other unlawful acts.
Harass, threaten, defraud, or abuse other users.
Upload malware or attempt to compromise website security.
Access another user’s account without authorization.
Collect personal information from other users for unlawful purposes.
Send spam or unauthorized commercial communications.
Manipulate reviews, inquiries, listing rankings, or other platform functions.
Circumvent applicable fees through deceptive conduct.
Infringe intellectual property rights.
Use the website in a manner that violates applicable law.
KodiGari may investigate suspected violations and take proportionate action, subject to applicable law.
13. Reviews, Feedback, and User Communications
If KodiGari provides reviews, ratings, or feedback features, users must submit honest and relevant information based on their genuine experiences.
Users must not publish fabricated reviews, manipulate ratings, threaten others with false reviews, or disclose another person’s confidential information without lawful authorization.
KodiGari may remove or restrict content that violates these Terms or applicable law.
Submitting suggestions or feedback does not require KodiGari to implement them. Any use of feedback must respect applicable rights and legal obligations.
14. Intellectual Property
The KodiGari name, logo, website design, original text, graphics, software, and other platform materials may be protected by intellectual property laws.
Except where permitted by law or expressly authorized in writing, users must not copy, modify, distribute, sell, or commercially exploit protected KodiGari materials.
Vendors retain responsibility for ensuring that they have the necessary rights to photographs, logos, descriptions, and other content they upload.
Nothing in these Terms transfers ownership of a user’s intellectual property to KodiGari, except for the limited content permission described in Section 7.
15. Third-Party Services and External Links
KodiGari may link to or integrate with third-party services, including payment providers, communication tools, mapping services, and external websites.
Those services may operate under their own terms, privacy policies, fees, and procedures.
KodiGari does not control every aspect of third-party services and is not responsible for their independent acts or omissions, except where applicable law provides otherwise.
Users should review the relevant third-party terms before using those services.
16. Privacy and Personal Information
Your use of KodiGari is also subject to our Privacy Policy.
The Privacy Policy explains how we may collect, use, store, and disclose personal information in connection with the platform.
Users must handle other people’s personal information lawfully and must not misuse contact details, listing information, messages, or other personal data obtained through KodiGari.
Publicly visible information should not be treated as permission to use it for spam, harassment, identity theft, or other unauthorized purposes.
For more information, please review our Privacy Policy on KodiGari.com.
17. Website Availability and Changes
We aim to keep KodiGari accessible and functional, but we do not guarantee uninterrupted or error-free operation.
The website may occasionally be unavailable because of maintenance, technical problems, security incidents, connectivity issues, or circumstances outside our reasonable control.
We may add, modify, suspend, or discontinue website features where reasonably necessary, subject to applicable law and any relevant contractual obligations.
We will not use this provision to exclude liabilities that cannot lawfully be excluded.
18. Account Suspension and Termination
KodiGari may investigate accounts or listings reasonably suspected of fraud, abuse, unlawful activity, security threats, or material violations of these Terms.
Depending on the circumstances, we may:
Request additional information.
Restrict or temporarily suspend an account or listing.
Remove unlawful or prohibited content.
Suspend access to a specific feature.
Terminate an account where justified.
Where appropriate and legally permitted, we may notify the affected user and provide an opportunity to respond or correct the problem.
Users may stop using KodiGari and request account closure in accordance with the applicable account procedures.
Suspension or termination does not automatically cancel a user’s existing legal obligations to another party or remove any rights and obligations that must survive termination.
19. Disclaimers
To the extent permitted by applicable law, KodiGari provides marketplace features on an availability basis.
We do not guarantee that:
Every listing is genuine, accurate, or current.
Every advertised vehicle is available when requested.
Every vendor or customer will fulfil their obligations.
A user will receive a particular number of inquiries, bookings, or earnings.
The website will always be available without errors or interruption.
Users should independently verify material information and take appropriate precautions before entering into a rental agreement or transferring money.
Nothing in these Terms excludes any express commitment made by KodiGari or any legal guarantee or consumer right that cannot lawfully be excluded.
20. Limitation of Liability
To the extent permitted by applicable law, KodiGari will not be liable for indirect or consequential losses arising from a user’s independent dealings with another user, including loss of anticipated rental income, missed opportunities, or disputes over a private rental agreement.
KodiGari is not responsible for a vehicle’s mechanical condition, a vendor’s failure to provide a vehicle, a customer’s misuse of a vehicle, or a payment made directly to another user, except where liability arises from KodiGari’s own conduct, an expressly undertaken service, or applicable law.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any other liability that cannot lawfully be excluded or limited.
Where liability can lawfully be limited, any limitation will apply only to the extent permitted by applicable law and in light of the circumstances.
21. Indemnity
To the extent permitted by applicable law, a user who engages in unlawful conduct or materially breaches these Terms may be responsible for losses, claims, or reasonable expenses directly arising from that conduct.
This provision does not automatically make a user responsible for losses caused by KodiGari’s own unlawful conduct, negligence where legally relevant, or other conduct for which the user cannot lawfully be held responsible.
22. Changes to These Terms
KodiGari may update these Terms to reflect changes in the website, business operations, platform features, or applicable law.
The revised version will be published on KodiGari.com with an updated revision date.
Where a change materially affects users’ rights or existing contractual arrangements, we will provide notice or obtain consent where required by law.
Continued use of the website after updated Terms take effect may constitute acceptance where permitted by applicable law. Where affirmative acceptance is legally required, we will seek it.
23. Governing Law and Jurisdiction
These Terms and Conditions are governed by the applicable laws of the United Republic of Tanzania.
Disputes relating to these Terms shall be handled by a competent court or other lawful dispute-resolution body with jurisdiction over the matter.
Nothing in this section prevents a consumer from exercising a mandatory right to bring a claim before a competent authority or court where applicable law permits.
24. Severability
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Any invalid provision will be interpreted or limited only as necessary to comply with applicable law.
25. No Waiver
Failure by KodiGari to enforce a provision of these Terms immediately does not automatically mean that the provision is waived.
Any waiver must be interpreted in accordance with applicable law and the circumstances in which it is given.
26. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular service or transaction, govern your use of KodiGari.
Where separate rental agreements are made between vendors and customers, those agreements govern the relevant rental relationship, subject to applicable law and these platform terms where relevant.
If an additional service has specific terms, those terms will apply to that service to the extent they do not conflict with mandatory legal requirements.
